Our online store is hosted by Wix Inc. They provide us with the e-commerce platform

By agreeing to these terms you identify being of at least legal majority age in your state or province of residence or have given us consent to allow any minority dependents to use this site.
 

We reserve the right to refuse service to anyone for any reason at any time. If we decide to cancel or change an order we will attempt to notify you via the email / billing address /phone number provided during purchase. We reserved the right to limit or prohibit ordersthat we deem to appear to be placed by dealers, resellers or distributors.
 

You agree not to reproduce, duplicate, copy, sell or resell any portion of the Product or Service without express permission by Paradiso Designs. All content of patterns (including instructions, illustrations, photos) are copyright protected and belong exclusively to Paradiso Designs. You may use the Product and Platform for your own personal and non-commercial use only as stated here and on physical Product.
 

You may not use our product for any illegal or unauthorized purpose. Breach of violation will result in immediate termination of Service.
 

Paradiso Designs has made every effort in production of its Product to create as accurate a product as possible. We reserve the right to modify, update or correct our Product as we see fit. Product descriptions and pricing are subject to change at any time without notice. We reserve the right to discontinue Product at any time.

 

We have made every effort to capture accurate color and images as to how the Product appears in person. We are not responsible and cannot guarantee that your personal computer monitor’s display will be accurate. We reserve the right to limit sales of our Product and Service to any person at any time.
 

We do not warrant that the quality of any Product or Service obtained by you will meet your expectations, or that an error in the Service will be corrected.

SECTION 2 - ACCOUNT, PASSWORD AND BILLING
You agree to provide current, accurate and complete information for all purchases made in our store. All information should be updated by you when necessary to complete transactions and contact you as needed.

 

You are responsible for the confidentiality of any password created. Furthermore, you are responsible for any and all activity that occurs under your account. You agree to notify Paradiso Designs immediately if you see any unauthorized use of your account or breach of security. Paradiso Designs will not be responsible for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge.
 

You will be held responsible for any losses incurred by Paradiso Designs or another party due to someone else using your account or password. You may not use someone else’s account at any time without direct permission from the account holder.
 

You will not use a false email address, pretend to be someone other than yourself or otherwise mislead us or third parties.
 

You understand that any of your content, which does not include credit card information, may be transferred unencrypted over various networks and maybe change to conform with requirements of connecting networks or devices.
 

Credit card information is always encrypted during transfer over networks. Your submission of personal information is governed by our Privacy Policy.

The Platform may contain links to sites or other products or services operated by other companies (“Third Party Platforms”) which we neither monitor nor have any control. We are not responsible for examining the content for accuracy and you agree to using these platforms “as is” / “as available”. Use of these Third Party Platforms are to be used entirely at your own risk and their policies should be carefully reviewed before you engage with the product or services.

SECTION 4 - CUSTOMER REVIEWS 
We reserve the right to monitor, edit or remove content we determine to be offensive, obscene, threatening, defamatory, unlawful or otherwise objectionable or that violates any party’s IP or these Terms of Use.
You agree when reviewing / commenting that you will not violate any right or any third party which includes copyrights, trademarks, privacy or other personal or proprietary right. You will also agree that your review / comments will not contain any of the above mentioned content that would result in removal. You are solely responsible for the accuracy of the review / comments you submit.

SECTION 5 - PROHIBITED USE
As a condition of your use of Paradiso Designs products and services, you agree not to use such products or services for any purpose that is unlawful or prohibited by these Terms of Use or in any manner that could damage, disable, overburden or impair any Platform, any Paradiso Designs server, any Paradiso Designs application or any network to which any Paradiso Designs server might be connected, or interfere with any other party’s use and enjoyment of the Platform. You agree not to attempt to gain unauthorized access to any Paradiso Designs products and service available through the Platform, other accounts,computer systems or networks to which any Paradiso Designs server may be connected through hacking, password mining or any other means. You agree not to obtain or attempt to obtain any materials or information through any means not intentionally made available to you through the Paradiso Designs product and services available through the Platform.

SECTION 6 - DISCLAIMER / LIMITATION OF LIABILITIES
Paradiso Designs does not promise that your use of the platform will be uninterrupted,timely, secure or error-free or that defects will be corrected. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that all products and services delivered to you through the platform are provided “as is” and “as available” for your own use at your own risk.
 

Paradiso Designs cannot ensure that any files or other data you download from the Platform will be free of viruses or contamination or destructive features.

At no point shall Paradiso Designs, it’s owner, directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including, without limitation of lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including
negligence), strict liability or otherwise, arising from your use of any of the service or any product procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a results of the use of the service or any content (or product) posited, transmitted or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the
exclusion of the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify and hold Paradiso Designs, it’s owner, directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers and licensors harmless from any and all demands, losses, liabilities, claims or expense (including attorneys’ fees) arising from or relating in any way to your use of the Product, Service or Platform, your use of the Platform, your conduct in connection with the Platform or with other Platform users, or any violation of these Terms of Use, any law or the right or any third
party.

SECTION 8 - TERMINATION
You agree that Paradiso Designs may terminate access to the Platform, block or restrict your future access to the Platform and delete your profile for any reason at any time. These terms remain in effect even after your account is terminated. You may terminate these terms at any time by contacting us if you no longer wish to use our services, or when you cease using our site.

In the event that any provision of the Terms of Use is held to be invalid, the remainder of these Terms of Use shall continue to be enforceable to the fullest extent permitted by applicable law.

You agree that this Platform, Terms of Use, Privacy Policy and any dispute between you and Paradiso Designs shall be governed in all respects by the laws of Oregon, United States of America.
